These Terms and Conditions (hereinafter referred to as “Terms”) define the rules for using the online store bluble.eu (hereinafter referred to as “Online Store”), operated by Bellumi Katarzyna Piechocka, with its registered office at Reduty Ordona 89b/U-1, 71-180 Szczecin, Poland, registered under PL9552234781, (hereinafter referred to as “Seller”).
1. General Provisions
1.1. These Terms apply to all contracts concluded through the Store between the Seller and a customer (hereinafter referred to as “Customer”).
1.2. The Customer is obliged to read these Terms before placing an order. By placing an order, the Customer accepts the provisions of these Terms.
1.3. The Seller reserves the right to amend these Terms. Any changes will be published on the Store’s website and will come into effect 7 days after their publication. Orders placed before the effective date of the changes will be subject to the provisions of the Terms in force at the time the order was placed.
1.4. The Store conducts retail sales via the Internet.
1.5. All product prices displayed on the Online Store’s website are given in Euros (EUR) and are gross prices (include VAT). Delivery costs are not included in the product price and will be clearly stated during the order placement process.
2. Definitions
2.1. Seller: Bellumi Katarzyna Piechocka, ul. Reduty Ordona 89b/U-1, 71-180 Szczecin, Poland, PL9552234781.
2.2. Customer: A person, or an organizational unit, who purchases goods or services from the Seller via the Store.
2.3. Consumer: A person performing a legal transaction with an entrepreneur. For the purposes of these Terms, this definition primarily refers to the definition of a consumer under Polish law and Article 2(1) of Directive 2011/83/EU on consumer rights.
2.4. Online Store: The online store operated by the Seller, available at the domain www.bluble.eu.
2.5. Product: Goods offered for sale in the Online Store.
2.6. Order: The Customer’s declaration of will to conclude a sales contract for a Product, specifying the quantity and type of Product, delivery method, and payment method.
2.7. Working Day: A day from Monday to Friday, excluding public holidays in Poland.
2.8. Consumer Rights Directive (CRD): Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council.
2.9. GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
3. Registration and Account
3.1. To place an order in the Online Store, the Customer is not required to register. However, registration allows for easier order tracking, access to order history, and faster future purchases.
3.2. Registration involves completing a registration form available on the Store’s website. The Customer must provide true and complete data.
3.3. After registration, the Customer receives a confirmation email to the provided email address, including a link to activate the account.
3.4. The Customer is responsible for maintaining the confidentiality of their account login and password and for all activities that occur under their account. The Customer must immediately inform the Seller of any unauthorized use of their account.
3.5. The Customer may at any time delete their account.
4. Ordering Process
4.1. Orders can be placed 24 hours a day, 7 days a week, except when sales are temporarily suspended due to technical reasons, website maintenance, or vacation periods.
4.2. To place an order, the Customer selects the Product, adds it to the shopping cart, and then proceeds to the checkout.
4.3. During the order placement process, the Customer provides the necessary data for order fulfillment, including delivery address, contact details, and chosen payment method. 4.4. Before confirming the order, the Customer receives a summary of the order, including the main characteristics of the Product, its price, delivery costs, and the total amount to be paid.
4.5. Placing an order constitutes an offer by the Customer to purchase the selected Product from the Seller under the conditions specified in the order summary and these Terms.
4.6. The sales contract is concluded when the Seller sends an email confirmation of the order acceptance to the Customer, which usually happens immediately after the order is placed and payment (if chosen as an immediate payment method) is successfully processed.
5. Prices and Payment
5.1. The prices of Products in the Online Store are primarily displayed in Euro (EUR) and are gross prices (including VAT). For the convenience of our international customers, the Online Store also provides the option to view product prices and complete transactions in other selected currencies: GBP and USD.
5.2. The total value of the order includes the price of the Product(s) and delivery costs. Delivery costs are specified during the order placement process and depend on the chosen delivery method and destination.
5.3. The Store offers various payment methods, including:
– Credit/Debit Cards: Visa, MasterCard, American Express, Maestro, and Discover, processed via the Payment Gateway Provider Stripe.
– Digital Wallets: Apple Pay, Google Pay, Revolut Pay (availability depends on your device and region)
– Local Payment Methods: Such as BLIK, EPS, Bancontact, also processed via the Payment Gateway Provider Stripe.
5.4. The availability of individual payment methods is dynamically adjusted and may vary depending on the country from which you are making the purchase, and the selected transaction currency. This means that some payment methods will be visible and available exclusively to customers meeting specific criteria, such as geographical location or the chosen payment currency.
5.5. Payments are processed by Stripe – an external payment service provider. The Customer’s personal data processed by these providers is subject to their respective privacy policies.
5.6. In the case of payment by online transfer or card, the order is processed after the payment is successfully received by the Seller.
6. Delivery
6.1. Products are delivered to the address indicated by the Customer during the order placement.
6.2. The delivery time depends on the availability of the Product, the chosen delivery method, and the destination country. Estimated delivery times may be provided on the Delivery info page and Product page.
6.3. The Seller is not responsible for delays in delivery caused by the carrier.
6.4. The Customer should inspect the delivered package for any damage during transport. In case of damage, the Customer should prepare a damage report in the presence of the carrier and immediately inform the Seller.
6.5. For international shipments, the Customer may be subject to import duties and taxes, which are levied once a shipment reaches the Customer’s country. Any additional charges for customs clearance must be borne by the Customer. The Seller has no control over these charges and cannot predict what they may be.
7. Right of Withdrawal (Right to Cancel) for Consumers
7.1. Right to cancel: A Consumer who has concluded a distance contract may withdraw from it without giving any reason within 14 days.
7.2. The withdrawal period will expire after 14 days from the day:
* in the case of a sales contract for a Product – the day on which the Consumer acquires, or a third party other than the carrier and indicated by the Consumer acquires, physical possession of the Product;
* in the case of a contract relating to multiple Products ordered by the Consumer in one order and delivered separately – the day on which the Consumer acquires, or a third party other than the carrier and indicated by the Consumer acquires, physical possession of the last Product;
7.3. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision to withdraw from the contract by an unequivocal statement by e-mail sent to: hello@bluble.eu.
7.4. To meet the withdrawal deadline, it is sufficient for the Consumer to send their communication concerning their exercise of the right of withdrawal before the withdrawal period has expired.
7.6. Effects of withdrawal: If the Consumer withdraws from this contract, the Seller will reimburse to the Consumer all payments received from the Consumer, including the costs of delivery, without undue delay than 14 days from the day on which the Seller receives the Product. The Seller will carry out such reimbursement using the same means of payment as the Consumer used for the initial transaction, unless the Consumer has expressly agreed otherwise.
7.7. The Seller will withhold reimbursement until the Seller has received the Product back.
7.8. The Consumer must send back the Product or hand it over to the Seller or to [person authorized by the Seller to receive the Product], without undue delay and in any event not later than 14 days from the day on which the Consumer communicates their withdrawal from this contract to the Seller. The deadline is met if the Consumer sends back the Product before the period of 14 days has expired.
7.9. The Consumer will have to bear the direct cost of returning the Product.
7.10. The Consumer is liable for any diminished value of the Product.
7.11. Exceptions from the right of withdrawal: The right of withdrawal from a distance contract does not apply to contracts for the supply of goods made to the Consumer’s specifications or clearly personalised.
8. Personal Data
8.1. The controller of personal data provided by the Customer in connection with the use of the Online Store is the Seller.
9.2. Personal data is processed in accordance with GDPR and other applicable data protection laws.
9.3. The purpose and scope of personal data processing are described in detail in the Privacy Policy. The Privacy Policy also contains information about the Customer’s rights regarding their personal data, such as the right to access, rectify, erase, restrict processing, data portability, object, and lodge a complaint with a supervisory authority.
9.4. By using the Online Store, the Customer acknowledges that they have read and understood the Privacy Policy.
9. Intellectual Property
9.1. All content available in the Online Store, including texts, graphics, logos, images, photographs is the property of the Seller and protected by copyright and other intellectual property laws.
9.2. Any use of the Store’s content without the express written consent of the Seller is prohibited.
10. Termination
10.1. The Seller may terminate the contract for the provision of electronic services (e.g., account maintenance) if the Customer violates these Terms, especially by providing false data or engaging in illegal activities.
10.2. The Customer may at any time terminate the contract for the provision of electronic services by deleting their account.
11. Out-of-Court Dispute Resolution
11.1. In the event of a dispute between the Seller and a Consumer, the Consumer has the right to use out-of-court complaint and redress procedures. 1
2.2. The Consumer may submit a request for out-of-court dispute resolution to the relevant provincial inspector of the Trade Inspection (Inspekcja Handlowa) or use the ODR platform (Online Dispute Resolution) provided by the European Commission, available at: https://ec.europa.eu/consumers/odr/.
11.3. Detailed information about out-of-court dispute resolution methods can be found on the websites of relevant public institutions, such as the Office of Competition and Consumer Protection (UOKiK) in Poland.
12. Final Provisions
The Seller shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to war, terrorism, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy or materials.
